1. Introduction

This Privacy Policy is implemented by Delightfully Dutch to provide transparency to customers. The language of this Privacy Policy also allows Delightfully Dutch to comply and sell to various markets who require certain provisions to be addressed in a Privacy Policy.

This Privacy Policy describes how and when Delightfully Dutch collects, uses, and shares information when customers purchase an item from Delightfully Dutch, contact Delightfully Dutch, or otherwise use Delightfully Dutch’s services or its related sites and services.

When potential and actual customer(s) interact with or purchase items from Delightfully Dutch, customer(s) are agreeing that they have read, understand, and agree with this Privacy Policy. This Privacy Policy strives to ensure utmost customer privacy while also allowing Delightfully Dutch to successfully operate and comply with requirements. Ultimately, if customers do not accept this Privacy Policy, including the “Customer Rights” section, customers must not interact with or purchase from Delightfully Dutch.

2. Privacy Statement- Change Control

This Privacy Policy may be updated periodically. If changes are made to this policy by Delightfully Dutch, the “Date Last Updated” will be updated at the beginning of the policy, which will serve as a customer notice.

3. Limited Scope

This Privacy Policy does not apply to the practices of third parties that Delightfully Dutch does not own or control, including Shopify or any third-party services a customer may access through Shopify. Potential customers can reference the Shopify Privacy Policy to learn more about its privacy practices.

4. Information Delightfully Dutch Collects

When customers place orders on this website, the customers are authorizing the release of certain information to Delightfully Dutch that’s needed to fulfill customer’s orders, such as the customer’s name, email address, postal address, payment information, and the details of the product that is being ordered. Customers may also choose to provide Delightfully Dutch with additional personal information if customers contact Delightfully Dutch directly.

5. Why Delightfully Dutch Needs Customer Information and How Delightfully Dutch Uses It

Delightfully Dutch relies on a number of legal bases to collect, use, and share customer information, including:

• As needed to provide Delightfully Dutch’s services, such as when Delightfully Dutch uses customer information to fulfill customer’s orders, to settle disputes, or to provide customer support;

• When customers have provided customer affirmative consent, which customer may revoke at any time, such as by signing up for Delightfully Dutch’s mailing list;

• If necessary to comply with a legal obligation or court order or in connection with a legal claim, such as retaining information about customer purchases if required by tax law; and

• As necessary for the purpose of Delightfully Dutch’s legitimate interests, if those legitimate interests are not overridden by customer rights or interests, such as:

o Providing and improving Delightfully Dutch’s services. Delightfully Dutch uses customer information to provide the services the customer requested and in Delightfully Dutch’s legitimate interest to improve Delightfully Dutch’s services

6. Information Sharing and Disclosure

Information about Delightfully Dutch’s customers is important to Delightfully Dutch’s business. Delightfully Dutch shares customer personal information for very limited reasons and in limited circumstances, as follows:

• Shopify - Delightfully Dutch releases customer information to Shopify, to the extend expressed in Shopify’s Privacy Policy.

• Service providers- Delightfully Dutch engages certain trusted third parties to perform functions and provide services to my shop, such as delivery companies. Delightfully Dutch shares customer personal information with these third parties, but only to the extent necessary to perform these services.

• Business transfers- If Delightfully Dutch sells or merges Delightfully Dutch’s business, Delightfully Dutch may disclose customer information as part of that transaction, only to the extent permitted by law.

• Compliance with laws- Delightfully Dutch may collect, use, retain, and share customer information if Delightfully Dutch has a good faith belief that it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce Delightfully Dutch’s agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of Delightfully Dutch’s customers, or others.

7. Data Retention

Delightfully Dutch retains customer personal information only for as long as necessary to provide customers with Delightfully Dutch’s services and as described in Delightfully Dutch’s Privacy Policy. However, Delightfully Dutch may also be required to retain and refer back to this information to comply with Delightfully Dutch’s legal and regulatory obligations, to resolve disputes, to support audits, and to enforce Delightfully Dutch’s agreements.

8. Transfers of Personal Information

Delightfully Dutch may store and process customer information through third-party hosting services in the US and other jurisdictions. As a result, Delightfully Dutch may transfer customer’s personal information to a jurisdiction with different data protection and government surveillance laws than customer jurisdiction. If a situation arises where Delightfully Dutch must email information, Privacy Shield is used as the legal basis for the transfer, as Gmail is Privacy Shield certified and is encrypted.

9. Customer Rights

Privacy laws vary from state to state and country to country, allotting customers different privacy rights and protections. For example, the European General Data Protection Regulation (GDPR) is a relatively new protection that provides EU users with rights related to their personal information. While some of these rights apply generally, certain rights apply only in certain limited cases. These rights are described below:

• Access. Customers may have the right to access and receive a copy of the personal information Delightfully Dutch holds about themselves by contacting Delightfully Dutch using the contact information at the end of this Privacy Policy.

• Change, restrict, delete. Customers may also have rights to change, restrict Delightfully Dutch’s use of, or delete customer personal information. Absent exceptional circumstances (like where Delightfully Dutch is required to store data for legal reasons), Delightfully Dutch will generally delete customer’ personal information upon request where possible.

• Object. Customer can object to (i) Delightfully Dutch processing some of customer information based on Delightfully Dutch’s legitimate interests and (ii) receiving marketing messages from Delightfully Dutch after providing express customer consent to receive them. In such cases, Delightfully Dutch will delete customer personal information unless Delightfully Dutch has compelling and legitimate grounds to continue using that information or if it is needed for legal reasons.

• Complain. If customers reside in the European Union and wish to raise a concern about Delightfully Dutch’s use of customer information (and without prejudice to any other rights customer may have), customers have the right to do so with customer local data protection authority. (Note: Delightfully Dutch strongly prefers and highly encourages customers to reach out directly to Delightfully Dutch to see if Delightfully Dutch can help answer questions prior to escalation).
